Nichols’ Life Might Hang On Juror Health

Interesting story up at CNN.com.

It seems that they’ve run out of alternate jurors in the Terry Nichols trial. If another juror is excused, then there will likely be arguments about whether or not the judge may empanel another jury to hear evidence in the sentencing phase.

Thanks to Ring v. Arizona 536 US 584 (2002), only juries are allowed to recommend the imposition of the death penalty. So, the question will be whether it has to be the same jury as the one that found guilt.
